  7. ‘You’ or ‘your’ refers to you, or your employer or any other entity or person that you have full legal authority to bind and on whose behalf you may be accepting this Agreement.

Use Subject to these Terms and Conditions

Your use of and access to this Site is at all times governed by this Agreement, and by accessing this Site you agree to adhere to this Agreement. Your agreement to this Agreement will be deemed to have been given on the date when you first accessed this Site.

  1. Arbitration.
    Any dispute between the parties arising out of or in connection with your visit to the Site or from this Agreement must be submitted to confidential arbitration. Such arbitration will be held in Cape Town (South Africa), subject to the arbitral law of South Africa. The parties consent to the sole jurisdiction of the High Court of South Africa in adjudicating disputes arising from or connected with the arbitration. The Arbitration Foundation of South Africa will act as the appointing authority.
  2. Urgent Relief.
    The aforegoing will not restrict our right to apply to a competent court for relief should its intellectual property rights be violated or threatened, and the parties consent to the jurisdiction of the Cape Division of the High Court of South Africa for such purposes.

Interpretation and General

  1. Whole Agreement.
    This Agreement is the whole of the agreement between the parties, and no document or statement not mentioned above will form part of it. Only a written variation, waiver or cancellation agreed to by both parties will be of any effect.
  2. Applicable Law & Jurisdiction.
    The law of the Republic of South Africa will apply to this Agreement, its interpretation and any matter or litigation relating to or arising from it, and the parties consent to the jurisdiction of the courts of Republic of South Africa in this regard.
  3. Survival.
    For the avoidance of doubt, any provision of this Agreement that anticipates any right or duty extending beyond the termination or expiry of this Agreement will survive the termination or expiry of this Agreement and continue in full force and effect.
  4. No Indulgence.
    If one party chooses not to enforce any part of this Agreement, that does not mean that the party cannot enforce that part at a later time. If any part of the Agreement is found to be unenforceable, the rest will still be enforceable.
  5. Representatives.
    The parties hereto acting in representative capacities warrant that they are authorised to act in such capacities, and accept personal liability under this Agreement should they prove not to be so authorised.
  6. Severance.
    In the event that any part of this Agreement is found to be partially or fully unenforceable for any reason, this will not affect the application or enforceability of the remainder of this Agreement.
  7. Broken Links.
    Notwithstanding the fact that hyperlinks in this Agreement to certain documents should be deemed part of this Agreement in terms of section 11 of the Electronic Communications and Transactions Act 25 of 2002, the fact that some or all of the hyperlinks may be non-operational, will not play a role in determination of the validity and interpretation of this Agreement.
  8. General Use of Site
    If you access the website from outside of South Africa, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction. If any of these terms of use are found unlawful, void, or for any reason unenforceable, then that provision will be considered severable from the remaining terms of use, and will not affect the validity and enforceability of the remaining provisions. SAAAD Directory Terms

The SAAAD Directory is not a complete listing of all dental professionals and allied practitioners who work in the field of dentistry in South Africa. The information contained in the SAAAD Directory has been supplied by members who have declared that the information they have provided is true and correct and has not been independently verified by SAAAD. Use of the SAAAD Directory is subject to the Terms and Conditions of Use for the SAAAD Site, and also to the following:

The use of the Directory by third parties to verify information about, or the credentials of, dentists (including but not limited to health care entities, hospitals, insurance companies, and/or healthcare fund organisations) is not sufficient to meet the standards of any regulatory agency, licensing agency or credentialing body, such as the Health Professions Council of South Africa (HPCSA) or others. The Directory does not contain sufficient information with which to verify dentist credentials. For further information about verifying dentist credentials, contact the HPCSA by phone or email.

The Directory and/or any of its data, listings or other constituent elements may not be downloaded, republished, resold or duplicated, in whole or in part, for commercial or any other purposes, or for purposes of compiling mailing lists or any other lists of dentists. The use of the Directory to establish independent data files or compendiums of statistical information is prohibited.

Disclaimer of Warranties and Liabilities

Although SAAAD undertakes reasonable efforts to keep the information contained in the Directory accurate, the information is not guaranteed and no responsibility is assumed for errors or omissions. SAAAD does not warrant the accuracy, completeness, timeliness or merchantability or fitness for a particular purpose of the information contained in the Directory; nor does SAAAD in any way endorse the individuals described in the Directory or the services they may provide.

SAAAD is unable to verify whether a dentist described in the Directory as a ‘specialist’ limits his or her practice to that specialty. In no event shall SAAAD be liable to you or anyone else for any decision made or action taken by you in reliance on such information. The above warranties are the only warranties of any kind either expressed or implied including warranties of merchantability or fitness for any particular purpose.

Online Payments Terms

To become a Member of SAAAD, renew your Membership Subscription, or book and pay for one of our Events, we recommend that you first register by visiting ‘Join SAAAD' and completing the registration section. Registration as a Member enables:

    • Membership discounts;
    • The ability to store your billing and delivery details;
    • Viewing your order history;
    • Directory listing for your practice, laboratory or company;
    • Access to our Members Zone and Forum.

Registration and/or use of the SAAAD Site constitutes your acceptance of this Agreement, including the SAAAD Online Payments Terms. The SAAAD Online Payments Terms shall apply as between SAAAD and yourself. SAAAD reserves the right to amend the SAAAD Online Payments Terms from time to time and any such amendments shall be deemed to apply as between yourself and SAAAD. Any such amendments will take effect immediately on posting of the amended SAAAD Online Payments Terms on the site.

To pay for Membership Subscriptions or Events on the SAAAD Site you must be over the age of 18 (eighteen) and be the holder of a valid MasterCard or Visa credit card ('Payment Card'). Alternately, providing you are transacting from South Africa, you may make an Electronic Funds Transfer (EFT) into our bank account.

Online Payments and Registration

To Register you will be required to provide certain information including personal details and your delivery address (in the case of Journal subscriptions). When registering you will be required to choose a User Name and a Password. Please keep your Password secret. SAAAD accepts no liability for any damages suffered or losses incurred from the use or misuse of your Password.

You will be required to enter your User Name and Password to login each time you visit the SAAAD Members Zone, to renew your Membership Subscription, or receive your discount for one of our Events.

To amend any registration particulars please visit 'My Profile' in the Members Zone and effect the amendments.

Credit Card Payments and Security

SAAAD accepts Credit Card and other payments via PayFast, an external payments processing service for South Africans and South African websites. If it is the first time that you are using PayFast, you will need to create an account on their external website. No credit card details are stored on the SAAAD website. When PayFast processes a transaction for you via any of the secure payment web services, the transaction is encrypted, making use of the latest SSL encryption which encrypts all data sent from the browser to PayFast in such a way that only the PayFast servers can read it. Users may go to to view their security certificate and security policy.

Customer Details Separate from Card Details

SAAAD customer details are stored separately from card details, which are entered by the client on PayFast's secure site. For more detail on PayFast, please refer to None of SAAAD's administrators or employees have access to your credit card details.

The private information required for executing the orders placed via the SAAAD Membership Subscriptions or Events Booking, namely your personal information, delivery address and telephone numbers will be kept in the strictest confidence and not sold or made known to third parties. Only the necessary information, that is the delivery address and contact phone number will be made known to third parties delivering the product (in the case of the subscriptions including the journals).

SAAAD will endeavour to ensure that your personal information details are protected as they travel over the Internet. However, there is no 100% secure transmission of data on the Internet given the current state of Internet technology. Therefore SAAAD cannot guarantee the absolute security of any information you transmit to us or which SAAAD transmits to you.

SAAAD cannot be held responsible for security breaches occurring on the User's personal computer or other electronic device used to browse the Site, which may result due to the lack of adequate virus protection software, or spyware that the User may inadvertently have installed on his/her device.

Merchant Outlet and Transaction Currency

The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction Currency is South African Rand (ZAR).

SAAAD Membership

Every member of the South African Academy of Aesthetic Dentistry (SAAAD) is required to subscribe to the HPCSA (or similar authority) Code of Professional Conduct and the SAAAD Contitution. The membership application and/or event registration is made in your personal capacity and not that of your employer. You are personally responsible for ensuring payment of any and all monies due to SAAAD.

Terms and Conditions of Membership

On the receipt of a membership application / membership renewal by the SAAAD Secretariat it is taken as confirmation that you have read, understood and accepted the Terms and Conditions of Membership and hereby acknowledge that you have familiarised yourself with the current Terms and Conditions, which will be displayed on our website

A membership application is the accepting of the Terms and Conditions, as well as any additional Terms and Conditions, Acceptable Use, Privacy Policy and Events Terms available on the website; it is deemed to be a legally binding contract.

Once a membership application has been processed, a proforma invoice is issued and you are legally obliged to pay the membership fee, upon which a tax invoice will be issued. SAAAD has the legal right, as well as an obligation to its members in good standing to take any and all steps to recover outstanding fees.

Practice. Laboratory, Company, contact and any other details as provided by the members are held on a central database and are deemed as being true and correct.

In terms of Chapter 3 of the Electronic Communications and Transactions Act, in visiting the Institutes website and/or communicating with the Institute by electronic means, you as an applicant and/or member acknowledges that all agreements, notices, disclosures and other communication sent by SAAAD satisfy any legal requirement including and not limited to the requirement that such communication should be in writing.

For access and usage to the ‘Membership Zone’ on the website, the member must keep their password confidential once issued via the website domain, and in the event that the member has compromised such information, SAAAD shall not be liable for any loss or damage suffered by the member in any way whatsoever.

The SAAAD website will be the definitive source for updated information and all intellectual property is owned by or licensed to SAAAD, and may not be used without our prior written consent. The SAAAD website may provide links to other websites, as a convenience to members; however SAAAD is not responsible for the content of any linked site and the inclusion of any link on the SAAAD site and does not imply endorsement by SAAAD of any other websites or their products or services.

Terms and Conditions of membership may be revised from time to time and such updates will be posted to the website. Therefore each time the member renews their Membership, the version of the Terms and Conditions current at that time will apply.

Payment Terms and Outstanding Fees

  1. Payment terms are strictly C.O.D. and no exceptions will be considered.
  2. Applicants and Members are advised that they are personally responsible for outstanding fees.
  3. The registration fee is due and payable on presentation of the proforma invoice.
  4. Any registration fees still outstanding after 90 days will result in the membership application being deleted from the database or the application for membership being not taken up and cancelled.
  5. Events
    1. Delegates are personally responsible for course, conference and workshop fees.
    2. Delegates who have not paid for conferences, courses, forums, seminars, workshops, etc will not be allowed to attend unless payment is received before commencement of the event.
    3. Cancellation fees will apply for events. Refunds for events / seminars will be strictly according to the terms and conditions of that event.
  6. No refund will be made on membership cancellations or resignation of member.
  7. Rates are inclusive of VAT, which is payable on all services directed from South Africa.

Membership Application and Renewal

  1. The option for an IJED Subscription (4 Volumes per annum) must be exercised by 1 December of each year to ensure delivery for the following calendar year from January to December.
  2. The membership fees are payable for new applications based on the month of joining i.e. September to last day of May the full twelve (12) month member fee is payable. Applications for new membership received from first day of June to last day of August pay half (½) of the annual fee.

  5. al membership fees become due and payable on 1 September of each year. Membership of SAAAD is renewable on an annual basis.
  6. The Applicant / Member consents to SAAAD carrying out education history checks as and when required.
  7. The Applicant / Member consents to SAAAD carrying out employment reference checks as and when required.
  8. It shall be the Member’s responsibility to update their information and inform SAAAD, in writing, of any changes such as a change of address, telephone numbers, etc.
  9. Membership fees are revised annually and are published on the website and will be communicated to members in writing.
  10. Members are given a total of three (3) months to renew their membership from the last day in August i.e. membership will lapse on the last day of November in the year of renewal.
    1. If the membership has not been renewed by the indicated expiry date the membership automatically expires and the member is then recorded as a cancelled member.
    2. Members whose membership has lapsed and who wish to reinstate their membership will be required to pay the full annual membership fee applicable at that time as well as a once-off re-registration fee for reinstating their membership and directory listings. This fee will amount to an additional 25% of the current Membership fee at the time.
  11. The renewal process is detailed in all of the notifications sent out.
  12. A member may not cede, delegate or otherwise transfer any rights or obligations arising from these Terms and Conditions without our prior approval, which approval will be given at SAAAD’s sole discretion.

Cancellation of Memberships

  1. Cancellation of membership will only be accepted in writing.
  2. Non-payment of an invoice will NOT be accepted as a cancellation of a membership application.
  3. You acknowledge that membership of SAAAD is on an individual basis only and as such you are personally responsible for ensuring the payment of all monies due to SAAAD and will be held personally liable for non-payment of any and all invoices issued in your name.
  4. Membership is not transferable.
  5. On termination of membership the awarded membership benefits lapse in line with cancellation date and the member must cease use of the SAAAD logo and certification.
  6. We may, at our discretion, suspend or terminate the registration of any User or Member who violates any of these terms of use of use, any of Member Terms and Conditions, the forum member guidelines or for any other behavior that we in our discretion believe is inappropriate.

SAAAD Events

Registration for the Events offered and run by us is made subject to the terms and conditions set out hereunder, in addition to being subject to the terms and conditions set out herein before. Please read them carefully and print a copy for future reference.

Terms and Conditions

To register for an Event, you will be required to provide certain information including certain personal details. It is not necessary to be a Member on the site to register for an Event, however should you choose to Join SAAAD and become a Registered Member user of the site, you will receive Member discounts and the registration process for Events is expedited. In this case, you will be required to first become a Member and choose a User Name and Password. Please keep your Password private. SAAAD accepts no liability for any damages suffered or losses incurred from the use or misuse of your Password.

On the relevant Event page, please complete the registration form and push the Registration Confirmation button. Registration constitutes your acceptance and agreement to be bound by the Terms and Conditions of our Site, including the terms below regulating the registration for Events.

Payment and Confirmation of Registration

Should you register for an Event, your registration will only be confirmed once you have made payment of the amount payable as stipulated on the particular Event web page, either via Electronic Fund Transfer (EFT) into the SAAAD bank account, the details of which will be provided on the website and registration email, and send us proof of payment; or via the Payfast secure online payments processing service. Payments by EFT must be effected within 5 Days of your registration, or your registration will be cancelled.

  1. Delegates are personally responsible for course, conference and workshop fees.
  2. Delegates who have not paid for conferences, courses, forums, seminars, workshops, etc will not be allowed to attend unless payment is received before commencement of the event.
  3. Cancellation fees will apply for events. Refunds for events / seminars will be strictly according to the terms and conditions of that event.

Upon receipt of your online registration and proof of payment, your invoice and confirmation of registration will be processed and sent to you. Should your billing information differ from your registration information, and you are paying via EFT, please include your billing information in your email containing your proof of payment.

Attendance of the Events

You agree to arrive timeously at the Event and bring along any writing materials or equipment as you may require.

Cancellation of Events

SAAAD reserves the right to cancel the Event in the case of insufficient interest or matters beyond our control. We will inform you as soon as possible if any Event has to be canceled for such reasons.

You may cancel your registration at any time within 15 (days) days of the respective Event you have registered for. In this regard, you must inform us in writing within 15 (fifteen) days of the date of the Event in question that you wish to cancel your registration, and this request must be accompanied by your full name and invoice / registration reference number.

Should you cancel your registration within less than 15 (fifteen) and more than 3 (three) days of the respective Event, you will be liable for 50% of the full Event Fee, unless other specific terms and conditions apply to the Event.

No refunds will be due for cancellations within less and 3 (three) days of the event.


SAAAD reserves the right, in its sole discretion, to change this Agreement from time to time without prior notice as it sees fit. Your continued use of the site will signify your acceptance of any adjustment to these terms and conditions. You are therefore advised to re-read this Agreement on a regular basis.

These terms and conditions form part of the Agreement between the Client and ourselves. Your accessing of this website and/or purchase of its Products or services indicates your understanding, agreement to and acceptance, of the Disclaimer Notice and the full Terms and Conditions contained herein. Your statutory Consumer Rights are unaffected.
